A big thank you to Timmy for passing along my letter to IOMFATS readers.

Los Angeles County District Attorney Steve Cooley's refusal to prosecute the beating of Treve Broudy as a hate crime indeed sends a frightening message to the citizens of Los Angeles. The L.A. community is not taking this matter lightly and it's heartening to see the community raise a collective voice against D.A. Cooley's decision. Still, as of this writing, Cooley has not changed his position and the charge against the three arrested men remains, robbery.

I don't believe that we can allow hate crimes, agaisnt anybody or group, to slip through the cracks or simply pretend that they will just go away. They won't - they'll increase. Cooley's message is both chilling and clear - that it's okay to bash gay men and women as long as it's done under the guise of robbery or some other motive.

I sent the block that Mark submitted to a friend of mine in LA who knows Treve Broudy personally, asking if it was currently accurate. They replied as follows:

Robert --- Yes and no.

"Yes" -- the DA says there is not enough evidence to indict for a hate crime (because no epithets where hurled). Also, the suspects in custody are denying that was their motive. They're not saying what their motive WAS... so you can be the judge of that. HOWEVER, the DA is not letting them go with a slap on the hand... he's indicating that that there is enough evidence to indict them for assault w/ deadly weapon, attempted murder...etc. etc.

"No" -- the DA is still investigating. The West Hollywood Sheriff's dept. and others are advocating loudly that the DA reconsider.

It's still clearly appropriate to lobby the DA's office.

Thanks Robert....I appreciate the information and am gratified to know that others have voiced concern. The community has certainly raised its voice both for and against Mr. Cooley's decision. Although I still find it difficult to accept the District Attorneys reasoning, I appalaud his decision to prosecute and the quick and thorough investigation by the police department. We may never know the real motive...however, what is particularly satisfying to me is the fact that crimes aginast gays are no longer easily dismissed. The community no longer looks the other way.

Remeber folks, we are all in this together. By that, I mean our exsistance on this planet, universe, galaxy, take that as far as you like. Apathy of injustice may be as bad as the crime itself. I am glad some of us here took part.
