Elena Kagan seems to be President Obama's choice to fill the vacancy on the highest court in the land, The Supreme Court. If so this will seat three women on the court, a first and welcome sign of equality in the sexes...we hope.

Since Kagan is unmarried, rumors abound that she is a lesbian. It is interesting to note that in decades past her Jewish heritige would have caused a clamor, but she will be only one of three Jewish members of the court if her nomination succeeds, the other six are Catholic. I imagine the Protestant faiths are a little concerned at the moment.

The personal life of any nominee will be subject to questioning in front of the Congressional panel that will review her credentials for the posting. It remains to be seen if the question of her sexual orientation is considered a necessary part of that inquiry.

The attached article covers some interesting ground as it seems many hope she is a lesbian, although that may have little influence on her decisions if she takes a seat on the high court. Go Elena!

To be completely honest I don't really know. I can tell that she is slightly to the right of Justice Stevens not by much, she is still classified among the more progressive/liberal wing of the Court. It will be entertaining to see the "right wing" of American politics call her a "radical" that term has lost all meaning within the "left" of the Supreme Court because the "right" is more radical than the "left" today. She is just another center-left nominee. Now we have moderates on the "left" vs ideologues on the "right". We would have to wait to see if she decides to mention anything about her sexual-orientation. Otherwise we won't have a clue.

The protestants who care most about the Supreme Court are those on the "right" leaning side of the American political establishment and they are perfectly happy with their four "right" leaning conservative catholics and they really don't care about the religion of the people on the supreme court they simply want ideologues on the court. We do need real moderates on the Supreme Court. I think the "right" will be more happy with Obama's choices for the Supreme Court than they think right now. Obama is not as radical as the far "right" assumes and by trying to once again change the definition of the words radical and moderate they risk dismantling their own political ideology for years to come.
