I just picked up coverage in http://www.wpix.com/news/wpix-riverside-babysitter-charged,0,1999838.story where a babysitter struck a 17 month old child to make him act in a more masculine manner.

"...Pedro Jones, 20, of South Hampton. He has been charged with first-degree manslaughter after allegedly hitting the boy "several times throughout his body with close fists" and grabbed him by the neck, according to the felony complaint filed by police."

So we have one sick man here. He fails to understand that children are children. At least he won;t fail to understand nay more children. But that is not the point of my post.

The first point is the location. I am not familiar with the USA and its attitude to the peoples displaced by the white settlers, but this was on the Shinnecock Indian Reservation on Long Island. SO it appears that a fine people will be tarnished by the crime. Jones isn't Shinnecock; he may be hispanic with the forename of Pedro. That is a supplementary problem. Two underclasses may well mean the prosecution will be mishandled.



The second is that this has been picked up as a potentially newsworthy anti gay hate crime according to the increasingly low quality 356 Gay News at http://www.365gay.com/news/man-accused-of-killing-infant-for-acting-like-a-girl/

"New York’s anti-discrimination laws do cover gender and sexual orientation, but there has been no word from police officials whether this crime will be investigated as a hate crime."

That looks to me to be a plea for folk to start trying to get it classified as such.

I think we'll find that this was just some stupid psycho jerk who should never have been near kids. It's pretty hard to consider this a hate crime. Hateful, yes. Hate, no.

We have to be careful what we wish for when trying to make every crime, however unpleasant, into a hate crime. We are not that special.

I cannot imagine why this man thinks his reasoning for doing this is even intelligent...17 months old for goodness sake. A child at that age has no blatant sexual feelings, they can barely talk.
This man has a deep psychosis and I agree with whomever yelled they better but him under the jail. 20 years will hardly be long enough if that's all they give him. But he is mentally impaired, it remains to be seen what happens.
A sad story, but the death of any child is like that. :'-(

There is a further aspect to this. The UK and the USA are very much into the State as Nanny. We will soon need qualifications for folk to babysit.

There is the difficult thought, too, that the mother bears a small proportion of the liability for the death for her sad misjudgment of the psycho who killed her child. Appearances can be deceptive, but he does look little better than floor sweepings.

But I am getting distracted. My real point is about hate crime.

We must not be fooled into giving every crime by a moron the label of Hate Crime. This is one of the reasons I am against the concept of Hate Crime in the first place.

I quite agree. The only comment made in the story about the boy acting out like a girl was in the excuse this man made for beating the child. No comments by the relatives back him up, and again what child of that age acts masculine?

The 360 site is just stirring up dust with it's Hate Crime allegations. How specific the man was about the child's acting out is unsaid, there will be further comments on this story I am sure.

The man is a psycho, a spiteful and hateful individual. Too often we read about women who leave their children with boyfriends and the child is attacked, raped or killed. This is not always true, there are some men who embrace the feeling of family with their girlfriend's kids.

But I also agree, one look at this monster is enough to tell me the child's mother had to be out of her mind as well, or desperate. She won't get a second chance now will she.

... 365gay.com; certainly since Viacom's buying it, it has gone from issue-oriented and event-based reporting to becoming nothing more than another commercial vehicle designed to further the parent company's other ventures, notably LOGO.

With regard to "Hate Crime", in Canada, in order for such label to be applied, and subsequently prosecuted, the veracity of it being hate-driven must be self-evident; usually of circumstances so heinous that people automatically cringe in disgust when details of the incident emerge; it's simply not enough to perceive an action as being hateful, it must have consequences that are indeed driven by hate.

Sadly, as we in Canada become more, and more, influenced by American Media, and our young people begin to think, and want to be, like our American brethren south of the border, this too may change. It has in many areas of our culture, and I suppose to expect our legal system to not to adopt what's being rammed down our throats at every opportunity 24-7-365.

Unfortunately in a society now ridden with "Tort Law" and superfluous, and often petty, legal briefs, and a moral climate which tries to explain away every miscreant and ne'er-do-well's actions with the rhetorical "something must have made, or driven, them to it", followed closely with defense claims of mental defect, hormonal imbalance, peer pressure, television, music ... hell, let's just throw in the kitchen sink too, shall we. No-one it transpires should ever be held accountable for their behaviour; there must always be someone or something to blame.

Pedro Jones alone, not his social (and cultural background) is the cause of this unfortunate child's death; hands-down, and flat-out, the cause; but, you watch, all manner of crazy hypothesis and excuses are going to be put forth in the defense of both him and his disgraceful murder of the child; and, he'll likely get away with it too, which disgusts me even more the either his actions, or the child's demise.
